The petitioner apprehends his arrest in Garkha P.S. Case No. 161/2016 registered under Section 307 and other sections of the Indian Penal Code.
The informant alleged that Bittu @ Ritik called him from his house and took him to some distance where his grand father Ramraj Sharma (the petitioner) was standing with a knife. The petitioner handed over the knife to Bittu @ Ritik, who assaulted the informant on different parts of his body. Learned counsel for the petitioner submits that the petitioner is the grandfather of Bittu @ Ritik. From the contents of the FIR, it does not appear to be believable that a grand-father would hand over a knife to his grand-son to cause injury to a person only because that person did not cast vote in his favour. It is submitted that the
Patna High Court Cr.Misc. No.30124 of 2016 (2) dt.08-09-2016 2/2 petitioner is an old man and he is hardly able to walk with a stick. It is further submitted that there is no allegation of assault against the petitioner.
Considering the facts aforesaid and the fact that the petitioner is an old man, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IV, Chapra, Saran in Garkha P.S. Case No. 161/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
