The petitioner has been in custody since 18.08.2017 in connection with Chhatauni P.S. Case No. 181/2017 registered for the offence punishable under Sections 302/120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that though the allegation is against four criminals who are said to have fired a shot at the father of the informant, the petitioner's name came only in connection with the present case on account of the fact that, it has been stated that the criminal who fired was hailing the name of the present petitioner. It is further submitted that admittedly the petitioner was not at the place of occurrence and only on suspicion and on the basis of the confessional
Patna High Court Cr.Misc. No.78450 of 2018(2) dt.28-01-2019 2/2 statement made before the police by one Arun Rai, the petitioner has been taken into custody. It is further submitted that the petitioner is languishing in jail since over a year and he shall cooperate in any further investigation and also be present during the course of the trial as and when required. Considering the aforementioned facts and circumstances and since no specific role has been assigned to the petitioner in the alleged occurrence, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 12th , Motihari, East Champaran, in connection with Chhatauni P.S. Case No. 181/2017, subject to the condition that one of the bailors will be a close relative of the petitioner.
