The petitioner apprehends his arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

As per the prosecution case, on the alleged date and time, the informant was informed by her husband that he has to visit his sister, so he would not come home. It is further informant that informant received a phone call whereby it is informed that her husband got electric shock and was being taken to Devlatand by petitioner and co-accused Umesh Singh. On the same day, one tempo carrying the dead-body of her husband stopped near her house. Informant suspects that all the FIR named accused persons including petitioner killed her

It is submitted that petitioner is none other than own nephew (Bhagina) of the deceased and he has been falsely implicated in this case merely on suspicion. There is general and omnibus allegation. Similarly situated co-accused Bulbul Devi has been granted anticipatory bail by a Coordinate Bench of this court vide order dated 07.02.2023 passed in Cr. Misc. No. 24497 of 2022 vide Annexure-2. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 416 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
