02. In the present case, the petitioner seeks bail in connection with Dhibra P.S. Case No. 14 of 2018, registered for the alleged offences under Sections 147, 148, 149, 341, 323, 307, 435, 427, 124(A), 429, 379, 506 of the Indian Penal Code and Section 17 of the C.L.A. Act.
03. As per prosecution case, petitioner and co-accused persons numbering 15-20 entered into a Gaushala and assaulted the persons working in the said Gaushala and took way the cattle. Thereafter, they set the Gaushala on fire. The miscreants also committed theft of motor pump, 22 kg electric wire, stoves, gas cylinders, utensils and other articles used in Gaushala apart from a mobile phone. Patna High Court CR. MISC. No.24747 of 2025(2) dt.30-04-2025 2/3 investigation as one of the miscreants who committed the said crime.
04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. There is no material against the petitioner to connect him with the offence as alleged. Nothing incriminating has been recovered from the person or possession of this petitioner. The petitioner has not been put to any test identification parade. The petitioner is having antecedent of six cases and out of which, he has been acquitted in three cases and is on bail in other three cases. The petitioner is in custody since 20.12.2024 and chargesheet has been submitted.
05. Learned APP for the State opposes the prayer for bail.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Aurangabad/court concerned in connection with Dhibra P.S.
Patna High Court CR. MISC. No.24747 of 2025(2) dt.30-04-2025 3/3 Case No. 14 of 2018, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
