2. The petitioner without exhausting the statutory remedy of appeal has approached this Court.

3. In the light of decision of the Apex Court in the case of State of Jammu and Kashmir V/s. R. K. Zalpuri and others reported in AIR 2016 SC 3006, the present petition is premature.

4. Accordingly, the writ petition is dismissed reserving liberty to the petitioner to prefer appeal before the

Patna High Court CWJC No.9348 of 2020(2) dt.03-01-2022 2/2 appellate authority. The appellate authority is hereby directed to take note of Section 14 of the Limitation Act and decide the petitioner's appeal to be submitted at the earliest. (P. B. Bajanthri, J) uday/- U
