JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2021 Learned counsel for the petitioner seeks permission to make correction in paragraph '1' of the bail application. Permission is accorded during the course of the day. Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Lalganj P.S. Case No. 208 of 2020 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 01.02.2021, charge-sheet has been submitted in the case and has got three criminal antecedents as mentioned in paragraph '3' of the bail application. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.34340 of 2021(2) dt.01-12-2021 2/2 allegation is of recovery of 16.150 litres of foreign liquor from a motorcycle.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and the motorcycle from which recovery has been made does not belong to this petitioner.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 01.02.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 208 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C.
