JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 20-09-2017 The present application has been filed for modification of order dated 19.05.2016 passed in Cr Misc. No. 43052 of 2015 for modifying the condition of making payment of Rs.1,800/- per month from June, 2016 to the informant. It appears that the petitioner, being the husband of the informant, preferred Cr. Misc. No. 43052 of 2015 in Kankarbagh P.S. Case No. 704 of 2014 registered for the offences punishable under Sections 498A, 341, 504 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act, pending in the Court of learned Chief Judicial Magistrate, Patna. On submission that since the petitioner has performed second marriage he was not ready to keep the informant, hence, it was submitted on behalf of

No.35650 of 2017 (2) dt.20-09-2017 2/2 the petitioner that the petitioner is ready to make payment of Rs.1,800/- per month from June, 2016 to the informant by depositing the same in her bank account number by second week of every month. On acceptance of the petitioner by the informant the order was passed. Now it is submitted that the petitioner is not ready to make payment to the informant.

In view of the fact that the order was passed on the submission of the learned counsel for the petitioner, this Court is not inclined to modify the earlier order. Accordingly, this application is disposed of.
