NILU AGRAWAL ORAL ORDER 29-04-2019 Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the State. The petitioners are languishing in judicial custody since 11.01.2019 in connection with Sandesh P.S. Case No. 9 of 2019 for the offences alleged under Sections 420, 472, 489(A) (C)(D)(E) and 120B of the Indian Penal Code.

The prosecution case, as lodged by the police personnel, is that on secret information that in the house of one Nagendra Yadav, son of Dev Narayan Yadav counterfeit currency notes are being printed, the police conducted a raid and apprehended persons engaged in printing the counterfeit notes and also seized large number of instruments used for printing. The petitioners were apprehended along with other co-accused. It has been submitted by the learned counsel for the petitioners that they are innocent, bear no criminal history and were lady members of the house and were not involved in the

Patna High Court CR. MISC. No.25694 of 2019(2) dt.29-04-2019 2/2 said offence. He submits that the petitioners were not found engaged in printing the counterfeit currency notes and that they are languishing in judicial custody since more than three months.

However, the learned Additional Public Prosecutor for the State opposes the prayer for bail.

Considering the nature of allegations, the period of custody and that the petitioners do not bear any criminal antecedent, as stated in paragraph 3 of the present application, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Sandesh P.S. Case No. 9 of 2019 to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, or the successor Court, subject to the condition that one of the bailors of each of the petitioners would be a close relative having sufficient immovable property, who will file an affidavit stating his/their relationship(s) with the petitioner(s).
