The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-12-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bochahan P.S. No. 88 of 2015 registered under Sections 341, 323, 324, 379, 307, 506 and 34 of the Indian Penal Code. The accusation is that petitioner along with his sons and wife armed with lathi, danda and knife surrounded the informant, Pradeep Sahni, and started to abuse, when the informant tried to flee away, then he was assaulted and at that time, petitioner gave the knife blow causing injury near his eye and nose. Thereafter, Ajay Kumar and Sachin Kumar, sons of the petitioner snatched cash Rs. 35,000/- from the pocket of the informant.

Learned counsel appearing on behalf of the petitioner submits that petitioner and informant are own brother

Patna High Court Cr.Misc. No.50111 of 2015 (3) dt.07-12-2015 2/2 and there is specific allegation against the petitioner to give knife blow near eye and nose of the informant, but no any injury of sharp cutting weapons is found. It is also submitted that petitioner has falsely been implicated in this case. In fact, wife of the petitioner earlier lodged Bochahan P.S. Case No. 86 of 2015 and also one Complaint Case No. 2368 of 2012 against the informant, due to that reason, the petitioner has falsely implicated in this case by the informant. It is further submitted that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M., Ist Class, Muzaffarpur in connection with Bochahan P.S. Case No. 88 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J.
