JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)A,26 and 35 of the Arms Act .

One country made loaded Katta is said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 30.08.2018. So far as criminal antecedent of the petitioner is concerned, it is submitted that prior to institution of the present case, one case i.e Nagar P.S.Case No. 549 of 2016 was registered against the petitioner but petitioner has already been acquitted in the aforesaid case.

No.78794 of 2018(2) dt.18-01-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai P.S. Case No. 538 of 2018.
