The petitioner apprehends his arrest in connection with Hajipur Town P.S. Case No. 313 of 2017 registered under Sections 420 and 406 of the I.P.C. and 138 of the Negotiable Instrument Act pending in the Court of C.J.M., Vaishali at Hajipur.
Submission is that petitioner is innocent and he has falsely been implicated in this case. The cheque was not the personal one, rather it was being operated jointly under the Joint Account.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with contention that there is
Patna High Court Cr.Misc. No.31452 of 2017 (4) dt.23-08-2017 2/2 direct allegation of committing fraud against the petitioner. Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer of the petitioner is rejected.
