Petitioner seeks bail in Dumaria Ghat P.S. Case No. 109 of 2018 registered for the offence punishable under Sections 392 of the Indian Penal Code.

Informant has alleged that while he was coming from Guwahati after loading articles on his container, in the way, he was overpowered by driver of Eon car and other persons sitting in that car and on strength of Arms got him seated in the said car and one of them started unloading the articles kept on the said container of the informant. In the meantime, police party came and on seeing them, they succeeded in fleeing away. But in the way due to mud the said car could not go further and all the miscreants fled away leaving him and the said car. Mobile

Patna High Court Cr.Misc. No.80158 of 2018(3) dt.07-02-2019 2/2 and Rs.13,500/- were also looted away from the informant. Petitioner is the owner of car.

Considering the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.

However, after framing of charges, the petitioner may renew his prayer for grant of bail.
