ABHISHEK REDDY ORAL ORDER 18-09-2024 The present writ petition is filed challenging the order dated 12.05.2023 whereby an appeal filed by the petitioner before the District Magistrate was dismissed for default due to non-appearance of the learned counsel for the petitioner.
2. Learned counsel appearing on behalf of the petitioner has stated that a direction may be given to the Respondent No. 2 to restore the appeal and recall the order dated 12.05.2023 and necessary orders may be passed on merits.
3. Having regard to the above made submission, the petitioner is granted two weeks' time for filing an application before the District Magistrate, Lakhisarai i.e. Respondent No. 2 for recalling the order dated 12.05.2023. If any such application
Patna High Court CWJC No.6684 of 2024(2) dt.18-09-2024 2/2 is filed, the same shall be considered on merits and necessary orders passed on merits. In case the appeal is restored, the petitioner shall be given an opportunity of hearing and necessary orders passed.
