02. 23.09.2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 376, 341, 323, 379, 504 and 506/34 of the Indian Penal Code. It is contended on behalf of the petitioners that the allegation of sexual exploitation is upon co-accused, Mukesh Kumar. So far as the petitioners are concerned, they along with five others have been alleged to have reached the house of the Informant, assaulted and snatched Rs. 2,500/- and also silver chain etc. It is further contended that in the statement recorded
Patna High Court Cr.Misc. No.37991 of 2016 (2) dt.23-09-2016 under Section 164 Cr.P.C. the victim girl has alleged that Sanjay Das had got her forcibly married with Sunil Das. It is also contended that entire family has unnecessarily been roped up in this matter.
Having regard to the facts and circumstances of the case, let the petitioners, namely, Sanjay Das, Manoj Das and Pintu Das be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Bihariganj P.S. Case No. 180/2015, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of concerned Judicial Magistrate, Udakishunganj, Madhepura subject to the conditions as laid down under subsection (2) of Section 438 of the Code of Criminal Procedure.
