JUSTICE JYOTI SARAN ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecution for the State.

The petitioner apprehends his arrest in connection with Mahua P.S. Case No. 463 of 2015 for the offences punishable under Sections 147, 149, 272, 273, 353, 224 and 308 of Indian Penal Code.

The allegations against the petitioner is of illegal sale of country made liquor as well as India Made foreign liquor. Learned counsel for the petitioner submits that although the petitioner has been charged in the F.I.R. of being engaged in illicit sale of liquor but he is not even shown in the accused column of the F.I.R. He submits that since the name of the petitioner appears in the body of the F.I.R. hence this prayer.

Having heard learned counsel for the parties and considering the nature of allegation as well as the circumstances

Patna High Court Cr.Misc. No.52911 of 2015 (2) dt.16-12-2015 2/2 existing, let the petitioner namely, Amresh Kumar Singh in the event of his arrest/surrender within four weeks from today, be released on bail upon furnishing bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 463 of 2015 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure. (Jyoti Saran, J) Bibhash/- U T
