JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-09-2016 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Patori P.S. Case no. 421 of 2015, registered under Sections 302, 324 and 120B/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and he is maternal brother of the deceased. After eight months of the occurrence, Police recorded the statement of the mother of the deceased, who admitted that on the date of occurrence, she was at her Myka in connection with treatment and she raised suspicion that this petitioner accompanied her son from his house, except that there is nothing against the petitioner. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his

No.35154 of 2016 (2) dt.02-09-2016 2/2 arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in connection with Patori P.S. Case No. 421 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
