2. The petitioners who apprehend arrest in connection with Banka P.S. Case No. 794/2023 lodged on 01.12.2023, for the offences punishable under sections 341, 448, 323, 337,504,506, 308,34 of the Indian Penal Code.

3. As per the prosecution, the F.I.R. has been lodged against four accused persons, including the petitioners, alleging that all the accused persons assaulted the informant using bricks and stones, thereby causing injuries.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. It is further submitted that the informant and the petitioners are

The present case has been lodged with false and frivolous allegations with an intention to grab the petitioners' land. The accusations made in the F.I.R. are omnibus and general in nature, without specific attribution of roles. Moreover, the injury report indicates that the injuries sustained are simple in nature. The petitioners are women with clean antecedents and deserve the benefit of bail.

5. Learned APP for the State opposes the prayer for bail.

In the facts and circumstances of the case, let the above-named petitioners be released on bail, in the event of their arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of 30,000/- ₹ (Rupees Thirty Thousand only) each, as mentioned in Section 2(1)(d) of the Bharatiya Nagrik Suraksha Sanhita, 2023, to the satisfaction of the learned CJM, Banka, in connection with Banka P.S. Case No. 794/2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
