Patna High Court CWJC No.10717 of 2014 (2) dt.02-12-2015 02-12-2015 Heard Mr. Sudhir Kumar Sinha, learned counsel for the petitioners and Mr. Rajesh Kumar Sinha, Assisting Counsel to G.P.-25 appears for the State.

I have perused the records.

The petitioners seek direction to the appropriate authority of the State Government for sanction of house under the Indira Awas Yojana. It is the contention of the petitioners that they applied for the benefit under the Scheme in 1999 and which was acted upon and under order dated 28.6.2003 passed by the Deputy Development Commissioner, Gaya they were found eligible to the benefits.

The grievance of the petitioners is that despite the acceptance of the claim no follow-up action has been taken. It is stated that one of the petitioners approached the District Magistrate and who directed the Director, National Employment Scheme for the needful although the order is not on record. In the circumstances discussed and having heard learned counsel for the parties, I deem it fit and proper to dispose of the writ petition with liberty to the petitioners to raise their grievance before the District Magistrate, Gaya along with supporting papers and any such representation so filed by the petitioners would be considered by the District Magistrate, Gaya

Patna High Court CWJC No.10717 of 2014 (2) dt.02-12-2015 either by himself or he may refer the matter to any other competent authority for the consideration. It is made clear that in any event the representation of the petitioners shall be disposed of in accordance with law and after opportunity of hearing to the petitioners expeditiously and preferably within three months of filing of such application.
