Petitioner along with other family members has been made accused in Ara (M) P.S. Case No. 50 of 2015 registered under sections 447, 323, 308, 354, 354(B), 379, 504/34 of the Indian Penal Code.

The informant has alleged that on the date of occurrence, the petitioner intruded into the house and tried to molest her. An attempt was made to undress her. When alarm was raised, other accused persons arrived there and they assaulted the informant and other family members.

Contention of the petitioner is that due to village politics, the case has been lodged by the informant. The other accused persons against whom general allegation has been attributed have

Patna High Court Cr.Misc. No.49057 of 2015 (2) dt.03-11-2015 2/2 been privileged with bail. It does not stand reasoned that petitioner would try to commit such offence in front of father and other family members.

Learned APP opposed the prayer for bail.

After going through the F.I.R. and the materials reflected from the impugned order which was passed after perusing the case diary, the allegation and those materials persuade me not to extend the privilege of anticipatory bail to the petitioner. Prayer is rejected.
