Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

Petitioners apprehend their arrest in connection with Kateya P. S. case no. 75/2016 registered under section 307 and other minor sections of the Indian Penal Code.

There appears to be case and counter case between the parties and persons from both sides sustained injuries and therefore, occurrence is admitted not only by the prosecution but also by petitioners. Therefore, in my view, it is not fit case for grant of anticipatory bail.

Accordingly, this petition stands disposed of giving liberty to petitioners to surrender before the court below within four weeks

Patna High Court Cr.Misc. No.35085 of 2016 (4) dt.15-11-2016 from today and seek regular bail and if they do so, the concerned court shall pass appropriate order on the regular bail application of the petitioners on its own merit without being prejudiced by this order. shahid (Hemant Kumar Srivastava,J) U T
