ANJANA MISHRA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Govindpur P.S. Case No.28 of 2016 registered for the offences punishable under Sections 47(a),(c) of Bihar Excise (Amendment) Act, 2016.

Learned counsel for the petitioner submits that five liters of Mahua liquor was found stored in aluminium vessels in her house. It is further submitted that the seizure was made not from her conscious possession and many other persons are residing in the said house and that she is an old lady aged about 70 years.

Considering the nature of allegations made and petitioner is an old lady aged about 70 years and that also there are

No.30412 of 2016 (2) dt.09-08-2016 2/2 no independent witnesses or witnesses of the said family, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Govindpur P.S. Case No. 28 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
