JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 01-07-2017 Heard the counsel for the petitioners and the State. Apprehending their arrest in Complaint Case No. C1/513 of 2014, registered under section 498-A and 379 IPC, the petitioners have filed the present application for grant of anticipatory bail.
It has been submitted that the petitioners are in-laws. The marriage between the complainant and the son of petitioner no.1 was performed at least 14 years ago. It is submitted that the petitioners have falsely been implicated in the case.
Patna High Court Cr.Misc. No.21168 of 2017 (2) dt.01-07-2017 2/2 Considering the facts and circumstances of the case, the petitioners above named, in the event of arrest/surrender within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in Complaint Case No. C-1/513 of 2014, Tr.No.2039 of 2016 on condition that one of the bailors in each case shall be own/close family members of the petitioners. In the event of framing of charge, the petitioners shall appear in person in the court concerned. In case of default on two consecutive dates, the trial court shall have liberty to cancel their bail bonds and secure their arrest in accordance with law.
