Petitioner apprehends his arrest in Mahila P.S. Case No.09 of 2019, registered under Sections 498A, 379 and 34 of the Indian Penal Code.

The wife of the petitioner alleged that after marriage, the petitioner and his family members assaulted her due to nonfulfillment of additional demand of dowry. She was driven out from her in laws house on 05.02.2018.

Learned counsel for the petitioner submits that the marriage of the petitioner was solemnized with the informant concealing the fact that the informant had illicit relation. The petitioner came to know about the extra marital relation of the

No.22235 of 2019(2) dt.08-04-2019 2/2 informant and filed Matrimonial (Divorce) Case No.387 of 2018 on 17.12.2018 in the court of Principal Judge, Family Court, Bhojpur, Ara. The present FIR was lodged on 14.01.2019. Taking into consideration the fact that the present case was lodged approximately one month after institution of the divorce case by the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bhojpur, Ara in connection with Mahila P.S. Case No.09 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
