====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-05-2025 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 191(2), 191(3), 126(2), 115(2), 118, 109,303(2), 76, 352 and 351(2) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, on the alleged date and time of the occurrence, all the FIR named accused persons including this petitioner assaulted informant and her family members by means of farsa, lathi, danda and fists and slaps and also tore clothes of the informant.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is only order giver and there is no allegation of assault against him. There is case and counter

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in Amaur Police Station Case No. 368 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
