Petitioner seeks regular bail in connection with Town PS Case No. 85 of 2022 registered under Section 25 (1-b)a 26/35 of the Arms Act.

The police intercepted a motorcycle in which the petitioner was sitting as pillion rider and recovered one loaded pistol and two live cartridges from the co-accused, Madhav Kumar who was driving the motorcycle.

Learned counsel for the petitioner submits that no fire arm has been recovered from the possession of the petitioner and he was a pillion rider on the said motorcycle which was being driven by the co-accused Madhav Kumar. He next submits that the name of the petitioner has transpired on the basis of disclosure of his name by the co-accused, Madhav

Regard being had to the submissions made by the parties and taking into consideration the materials available on record, no fire arm has been recovered from the possession of the petitioner, he is in custody since 10.02.2022 and the chargesheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Town PS Case No. 85 of 2022.
