ANJANA MISHRA ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Kurhani (Kudhni Turki O.P.) P.S. Case No.409 of 2016 for allegedly having committed the offence under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that there is a dispute between the parties and the allegations made are wholly mischievous. There has been no repetition of blows as is very much evident from the injury report.
In view of the fact that there is no repetition of blows, no case under section 307 I.P.C. has been made out. As such,
Patna High Court Cr.Misc. No.27720 of 2017 (2) dt.01-07-2017 2/2 let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Nayan Kumar, learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Kurhani (Kudhni Turki O.P.) P.S. Case No.409 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
