JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-07-2017 Learned counsel for the petitioner seeks permission to withdraw the prayer for bail on behalf of petitioner No.1 Ruplal Paswan.
The prayer is allowed. The prayer for bail on behalf of petitioner No.1 Ruplal Paswan stands withdrawn. Heard learned counsel for the petitioners and the State. Petitioner Nos. 2 to 9 apprehend their arrest in a case under
Patna High Court Cr.Misc. No.17200 of 2017 (4) dt.01-07-2017 Sections 147, 149, 323, 379, 504, 506, 447 and 448 of the Indian Penal Code and Section 3/4 of the Dian Act.
Learned counsel for the petitioners submits that the instant case is a counter blast of the earlier case filed by petitioner No.1 Ruplal Paswan against the husband of the informant. He further submits that the petitioners have clean antecedent and the allegations against the petitioner nos. 2 to 9 are ornamental in nature.
Considering the facts and circumstances of the case, the petitioner nos. 2 to 9, namely, Sanju Devi, Nitesh Kumar Paswan @ Nitesh Paswan Kumar @ Nitesh Kumar, Subodh Paswan , Sangeeta Devi, Chandeshwar Paswan, Ramdulari Devi, Ramnath Paswan and Rupkali Devi, are directed to be released on anticipatory bail, in the event of their arrest/surrender, on furnishing bail bonds of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in Madhuban P.S. Case No.215 of 2016.
