JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-07-2017 The petitioner apprehends his arrest in a case under Sections 147, 148, 149, 307, 324 and 504 of the Indian Penal Code.

The informant stated that on 10.11.2016 at about 3.30 PM he was sitting on his doors along with his children and other family members. In the meantime, 12 named accused persons and others, belonging to Munna Singh group, variously armed, came and started hurling abuse from behind the Mahabir Mandir. They also started firing. On hearing the firing sound, informant along with others came out on the road. In the meantime, the accused persons again resorted to firing. The informant specifically stated that the firing opened by seven accused persons, namely, Ravi Ranjan Singh @ Pintu Singh, Pradip Kumar Singh @ Munna Singh, Subhas Singh, Shyam Kishore Singh @ Arvind Singh, Deepak Pandey, Anil Pandey, Ranjay Singh @ Guddu Singh, Mritunjay Kumar Raj @ Sheru Singh injured his family members. The informant has alleged that the petitioner also opened fire by his rifle on the prosecution party. Learned counsel for the petitioner submits that he has falsely been implicated in this case on account of village politics. He submits that the informant specifically stated the names of his

No.17883 of 2017 (2) dt.01-07-2017 2/2 family members who sustained fire arms injuries caused by these seven persons injured, but has not specifically named the person who was injured in the fire opened by the petitioner. Furthermore, most of the injuries are superficial in nature. It is further submitted that for the same occurrence, two more cases were instituted, one being Bihta Police station Case No. 846 of 2016 dated 10.11.2016 was lodged by Deepak Pandey, coaccused and nephew of Pintu Pandey for the offence under sections 147,148,323,149,307,504,379 of the IPC and 27 of the Arms Act, while other case was instituted by the officer in charge of Bihta Police Station bearing Bihta Police station Case No. 865 of 2016 dated 10.11.2016 in which the petitioner in which petitioner is not named as an accused. Further, father of the petitioner and other villagers have filed representations to the District Magistrate on 26.4.2016 against illegal mining of sand from the sand ghat on account of which petitioner has been implicated in the instant case.

Having regard to the facts and circumstances of the case, in the even of arrest/surrender, let the petitioner, as mentioned above, be released on bail on furnishing bail bond of Rs.5000/- with two sureties of the like amount each to the satisfaction of the ACJM, Danapur, Patna in Bihta Police station Case No. 863 of 2016.
