The petitioner is apprehending his arrest in connection with Supaul P.S.Cse No.88 of 2006 registered for offences punishable under Sections 147, 148, 323, 341, 325, 337, 384,307 of the Indian Penal Code.

As per the FIR the allegation is that while the counting was being made of the prisoners, some mar-pit took place and 08 accused persons are named including the petitioner that they assaulted by Danda etc. and the case is of the year, 2006. Submission of the learned counsel for the petitioner is that he has no knowledge about the same and later on when he was acquitted in another case, he came to know about the same . Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.22522 of 2019(3) dt.14-05-2019 2/2 circumstances, as stated above, let the petitioner surrender before the learned court below and pray for regular bail, which will be considered by the learned court below on the basis of materials available on the record and if possible to be disposed of on the same day.
