ANJANA MISHRA ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel for the victim girl.
The petitioner apprehends her arrest in connection with a case registered for the offences punishable under Sections 341/323/363/366A/379(A)/370(d)/372/373/120(B) of the Indian Penal Code, Section 3/4/5/6/7/8/9 of the Immoral Traffic Act and Section 4/8 of the POSCO Act.
It is submitted on behalf of the petitioner that though she is named in the First Information Report, the statement of the victim girl did not indicate the name of the present petitioner and as such, she cannot be implicated in the present case on the basis of mere hypothesis.
Patna High Court Cr.Misc. No.32603 of 2016 (2) dt.16-08-2016 P2/2 Learned counsel appearing on behalf of the victim girl Geeta Kumari, however, submits that this petitioner was also one of the women who has been engaging her in the act of trafficking and, therefore, she also should not be spared, though both the girls have not taken the name of the present petitioner in their statement made under Section 164 of the Cr. P.C.
Having heard learned counsel for the petitioner and learned counsel appearing on behalf of the Geeta Kumari and also learned Additional Public Prosecutor for the State and the statement made by the two girls under Section 164 of the Cr. P.C., let the petitioner Minu Devi, in the event of her arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1stcum-Special Judge, Begusarai in connection with Ballia P.S. Case No. 163/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
