ANJANA MISHRA ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the informant. The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 307 and other sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is of attacking one Md. Azul with Farsa. However, the injury report which has come, shows that there is injury of hard and blunt substance though the same has been found to be grievous in nature. He further submits that with regard to the same occurrence, the petitioner's own brother Sheikh Kalim had filed a case stating that after the fight between the parties at the Masjid, the informant alongwith others had entered

Patna High Court Cr.Misc. No.18097 of 2015 (3) dt.13-10-2015 P2/2 into his premises and had attacked all the family members and indulged in lootpaat.

Considering the nature of allegations and that there is case and counter case between the parties and also that the petitioner has got no criminal antecedent, let the petitioner abovenamed, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Kadwa P.S. Case No. 204 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U
