Petitioner, who is in custody, seeks bail in connection with Sherghati P.S. Case No. 525 of 2018 registered for the offences punishable under Sections 341, 323, 504, 506, 324, 307, 34 of the Indian Penal Code. Informant has alleged in her written complaint that on 17.09.2018 petitioner along with other co-accused in drunken state abused the informant and on protest made by Raj Kumar Yadav, wife of petitioner, Kailash Yadav pelted bricks causing injury to Raj Kumar Yadav and other co-accused also damaged the house of the informant. Kailash Yadav inflicted Tangi blow to the son of informant namely Randhir Kumar upon his head causing three fracture injuries and petitioner also inflicted khanti blow upon him causing injury on his nose.
Patna High Court Cr.Misc. No.80456 of 2018(4) dt.25-01-2019 2/2 It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to dirty village politics. Petitioner has no criminal antecedent and is in custody since 19.09.2018.
Considering the nature of allegation against petitioner, I am not inclined to grant bail to the petitioner at this stage, as such, the prayer for bail is rejected. However, it is observed that petitioner may renew his prayer for bail after framing of charge. (S. Kumar, J) Rajiv/- U T
