The petitioner seeks bail in Naubatpur P.S. Case No. 335/2018, instituted for offences under Section(s) 341, 323, 354/34 of the Indian Penal Code. Later on Section 302 of the Indian Penal Code was also added.
It is alleged in the written report that due to kidnapping of son of informant, accused persons including this petitioner assaulted him, his mother and other family members. It is alleged that due to assault caused by accused persons, mother of informant sustained grievous injury and subsequently died during course of treatment.
Learned counsel for the petitioner has submitted that petitioner has been implicated in this case due to previous enmity. Mother of informant has died her natural death caused
Patna High Court CR. MISC. No.21917 of 2019(4) dt.04-07-2019 2/2 by an accident but after about 20 days of the alleged occurrence, the informant gave colour to her death as murder in the instant case.
It is further submitted that prior to institution of the instant case, wife of petitioner has filed Naubatpur P.S. Case No. 334/2018 against the informant of instant case and others. The other co-accused has already been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 20.06.2019 passed in Cr. Misc. No. 21188/2019. Petitioner is in custody since 20.08.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IInd, Danapur, Patna, in connection with Naubatpur P.S. Case No. 335/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
