JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Bheja P.S. Case No. 62 of 2018, dated 12.07.2018, instituted for the offences under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.

A long and unwinding story has been narrated in the First Information Report. However, so far as the assault is concerned, it has been alleged that the petitioner gave a

The learned counsel for the petitioner has submitted the allegation on face of it appears to be incorrect as the informant has received injuries by hard and blunt substance which have been opined to be simple in nature. There is not even a cut injury on the hand of the informant. In the other case in which the petitioner has made accused earlier, he has been granted bail and the aforesaid case has been lodged at the instance of his agnates.

Considering the facts aforestated, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Jhanjharpur, District-Madhubani in connection with Bheja P.S.
