JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 11-07-2023 Heard learned counsel for the petitioner, informant and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is said to have fired upon the informant which hit in his left hand arm.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the injury found upon the victim is simple in nature. He submits that there is no specific overt act against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.
Patna High Court CR. MISC. No.25090 of 2023(2) dt.11-07-2023 2/2 Learned APP for the State and learned counsel for the informant oppose the prayer for bail and submit that there is direct and specific allegation against the petitioner to fire upon the informant.
Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Khanpur P.S. Case No. 323 of 2022. (Anjani Kumar Sharan, J) devendra/- U T
