JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 27-03-2015 After having heard the parties for sometime, learned counsel appearing on behalf of the petitioner has fairly conceded that the reliefs no. 1, 2 and 3 enumerated in paragraph-1 of the writ petition have become infructuous in view of the subsequent developments and passage of time.
So far relief no. 4 is concerned, his grievance is that the Government resolution dated 31.01.2008 (Annexure-1) is not followed by the State authorities. It is observed that whenever fresh tenders are issued, in appropriate cases, the authorities of the respondent State, before finalising the tenders, shall take into consideration the aforesaid Government resolution and only thereafter shall proceed further in accordance with law. The writ petition stands dismissed with the observations made above.
