A copy of the Order, dated 24.11.2010, passed in the Contempt Application of the petitioner, which was M.J.C. No. 2564 of 2010, has been produced by the counsel for private-respondent nos. 4 and 5. If this is the observation of the Learned Single Judge, then the petitioner has been given liberty to challenge appointment, so made in terms of the previous direction of the Court.

Since no appointment has been made, there is no occasion for this Court to decide or direct anything

Patna High Court CWJC No.1003 of 2011 dt.27-01-2015 2/2 in favour of the petitioner as a piecemeal kind of exercise.

If appointments are made, petitioner has liberty to assail that appointment on all the legal grounds, which may be available to him, before the tribunal, constituted in this regard or before this Court, if the order is detrimental to the petitioner.

Writ application is, otherwise, dismissed with liberty as above.
