01-07-2017 After some argument, learned counsel for petitioners, considering the observation of the court below whereby while rejecting the prayer for bail learned 2nd Addl. Sessions Judge, Araria had noticed that petitioner no. 1 was aged about 78 years and his wife petitioner no. 2 was aged about 77 years and both were very old, infirm and weak from vision, requests for disposal of the present petition so that petitioners may appear before the court below and make a prayer for regular bail. He further submits that husband of the deceased is already in custody. This submission was made in presence of Sri Abhay Kumar No. 1, learned Addl. Public Prosecutor as well as Mr. Md.
Naushaduzoha, learned counsel for the informant.

No.21821 of 2017 (2) dt.01-07-2017 2/2 Considering the submission made by learned counsel for petitioners as well as observation of the court below, which has been made on 13-04-2017 in A.B.P. No. 356 of 2017, the petition stands disposed of with an indication that if within a period of six weeks from today the petitioners appear before the court below and make a prayer for regular bail, the learned court below, without being prejudiced with this order, may examine the same and considering the old age of the petitioners pass appropriate order in accordance with law, preferably on the same date. The petition stands disposed of.
