JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 01-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Chandi P. S. Case No. 14 of 2017 registered under Section 379/34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioners that apart from the fact that the petitioners were seen running away from the place, there is no other material to connect them with the alleged offence. It is further submitted that the allegations made in the FIR do not attract the
Patna High Court Cr.Misc. No.25310 of 2017 (2) dt.01-07-2017 2/2 ingredients of the offence punishable under Section 397 of the Indian Penal Code.
Regard being had to the nature of the allegation, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. (IV), Bhojpur, Ara in Chandi P. S. Case No. 14 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
