24-11-2015 Heard learned counsel for the Punjab National Bank. No one appears on behalf of the petitioner.

By the order of the Writ Court, sale of petitioner's mortgaged assets was stayed subject to petitioner making payment in installments as fixed by the Court. Petitioner alleges that he had been making payment, but suddenly at the time of the order of the Writ Court sale notice has been issued, which is Annexure - 2 to the application. A show cause has been filed by the Punjab National Bank admitting its mistake and clearly stating that due to communication gap

Patna High Court MJC No.1089 of 2009 (2) dt.24-11-2015 between the recovery office and the legal cell the notice of sale was issued which has since been recalled and will not be enforced in any case.

In view of the aforesaid undertaking, there is nothing remained in this application. This application is, thus, disposed of.
