The petitioner seeks bail in connection with Matihani P.S. Case No.41 of 2023 registered for the offence under Sections 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner along with other co-accused persons is to have caused firearm injury upon the informant.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that no allegation

No.27286 of 2024(2) dt.20-04-2024 2/2 as regard to causing firearm injuries against this petitioner rather the allegation as regard to calling outside the informant is levelled against this petitioner, where, there is allegation as regard to causing firearm injury is against other co-accused person, namely, Shambhu. It is further submitted that petitioner is a man of clean antecedent and he is in custody since 04.10.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Matihani P.S. Case No.41 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai.
