The petitioner is languishing in custody for the offence punishable under Sections 302/34 of the Indian Penal Code in connection with G.P. Nagar P.S. Case No. 153 of 2018. Petitioner allegedly gave a dagger blow as a result whereof mother-in-law of the informant died. Two other eyewitnesses have also supported the allegation. Submission of learned counsel for the petitioner is that petitioner is in custody since 26.05.2018 having no criminal antecedent.
Considering the nature of allegation and nature of material, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused.
Patna High Court CR. MISC. No.1582 of 2019(4) dt.02-05-2019 2/2 The learned trial Court is directed to expedite the trial and conclude the same preferably within nine months, failing which the petitioner would be at liberty to renew the prayer for bail before the trial judge itself.
