JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 30-03-2022 The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code. From perusal of the case diary, it appears that Section 83 Cr.P.C proceeding has already been initiated against the petitioner.

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for anticipatory bail of the petitioner and submitted that this petition is not maintainable since requisition of Section 83 Cr.P.C proceeding has already been initiated against the petitioner.
