JUSTICE MUNGESHWAR SAHOO ORAL ORDER 08-10-2015 Heard the learned counsel for the petitioner, Navjyot Singh @ Navjot Singh who apprehends his arrest in Awtarnagar P.S. Case No.154 of 2014 registered for the offence punishable under 135 of the Electricity Act.
It appears that the allegation against the petitioner is that he committed theft of electricity by Toka. The learned counsel for the petitioner submitted that the amount will be deposited with the Electricity Board within two months.
In view of the submission of the learned counsel for the petitioner and the nature of allegation, I direct that the
Patna High Court Cr.Misc. No.41593 of 2015 (2) dt.08-10-2015 2/2 petitioner to surrender before the Court below within two months from today and on his so surrendering, the Court below is directed to release him on bail on furnishing bail bond of Rs. 5,000/- (Five Thousand only) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Saran at Chapra in connection with Awtarnagar P.S. Case No.154 of 2014, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
