2. The petitioner seeks bail in Bihariganj P.S. Case No. 390 of 2024 registered for the offences punishable under Sections 115(1), 118(2), 126(2), 109, 103(1), 352 and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. The allegation is that the petitioner has assaulted the husband of the informant with a bamboo pole due to which the husband of the informant died on the spot.

4. Considering that the petitioner is the main assailant of the deceased, this court is not inclined to grant bail to the petitioner.

5. Accordingly, the prayer for the bail of the petitioner is rejected.

7. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application.
