JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 The petitioner seeks regular bail in connection with S. Tr. No. 250/16 + 627/15 arising out of Pear P.S. Case No. 35/15, registered for offences punishable under Sections 447, 341, 307 and 504/34 of the Indian Penal Code. Earlier the prayer for bail of the petitioner was rejected vide order dated 08.12.2016 passed in Cr. Misc. No. 48966 of 2016 by the then coordinate Bench of this Court. Allegation against the petitioner and his brother is of inflicting knife blow to the father of informant and when her mother came to save him, she was also assaulted by dagger. It has been submitted on behalf of the petitioner that he has been in judicial custody for last four years and uptil now no substantive progress has been made in trial.

No.24228 of 2019(3) dt.21-05-2019 2/2 Learned counsel for the State as well as informant opposed the prayer for bail and submitted that after conclusion of the evidence of both sides, the case was fixed for argument and, thereafter, a petition filed by the defence was dismissed against which, the defence preferred quashing application before this Court and after dismissal of the quashing application, the case is posted for argument.

Having heard both sides, in view of the above facts, I am not inclined to enlarge the petitioner on bail. This application is, accordingly, dismissed.
