The petitioners seek anticipatory bail in connection with Derni P.S. Case No. 43 of 2015 registered under Section 379 of the Indian Penal Code.
According to the prosecution case, the informant's motorcycle was stolen by some unknown criminal. In course of investigation, one Lallu Kumar was arrested by the police who has confessed his guilt and has named the petitioner as one of his associates in committing the crime.
Learned counsel for the petitioners has submitted
Patna High Court Cr.Misc. No.42346 of 2015 (2) dt.08-10-2015 2 / 2 that save and except the confessional statement of co-accused Lallu Kumar, there is no other material to connect the petitioners with the alleged offence.
Learned counsel for the State has opposed the prayer for bail.
Taking into consideration the nature of offence, I am not inclined to grant bail to the petitioners. Accordingly, their prayer for bail is rejected.
