Petitioner seeks bail in connection NDPS case no. 08/2020 arising out of Kaler P.S. Case no. 27 of 2020 registered for the offence punishable under sections 8/20(b) (ii) C/25/29 of the NDPS Act.

Learned counsel for the petitioner submits that the informant in the FIR alleges that he received information that a container vehicle bearing registration no. HR 38Q-9290 was coming from Aurangabad to Patna loaded with consignment of Ganja, accordingly, he informed the superior authority and Magistrate was deputed and thereafter it is alleged that vehicle was intercepted and on search 290 kg ganja was recovered. He further submits that petitioner is driver and owner of the vehicle

Patna High Court CR. MISC. No.32883 of 2021(2) dt.30-11-2021 2/2 has already been arrested.

Learned APP vehemently opposes the prayer for bail and submits that huge quantity of ganja has been recovered much more than commercial quantity.

Considering the facts that commercial quantity of ganja has been recovered, this court is not inclined to enlarge the petitioner on bail and accordingly, his prayer for bail is rejected. At this stage, learned counsel submits that charge has been framed the court below is directed to expedite the trial and conclude the same at the earliest.
