JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-07-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 353, 307, 384 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that on secret information that accused persons have assembled near Balu Ghat for the purpose of extortion, raid was laid and seventeen accused persons including the petitioner were identified. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the seized cartridges. There is general and omnibus allegation against the petitioner. A statement has been made in para 3 of the petition that petitioner is accused in two other cases apart from the present one.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bhojpur at Ara in connection with Shahpur
