JUSTICE RAKESH KUMAR ORAL ORDER 28-07-2016 After some argument, Sri Ravi Ranjan, learned counsel for the petitioners, in presence of Sri Akshay Lal Pandit, learned Addl. Public Prosecutor, makes a prayer for disposal of the present petition, so that the petitioners may appear before the court below and make a prayer for regular bail. At the time of argument, it was submitted by learned counsel for the petitioners that in identical situation, number of F.I.R. accused persons have been extended the privilege of anticipatory bail on 20.05.2016 vide Cr.Misc.No.11487 of 2016 and other two cases. The prayer is allowed.
The petition stands disposed of with observation that if within six weeks from today, the petitioners appear before
Patna High Court Cr.Misc. No.28463 of 2016 (2) dt.28-07-2016 2/2 the court below and make a prayer for regular bail, the learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law. While passing the order, the learned court below may consider the fact that other co-accused persons in identical situation have been granted anticipatory bail.
